These Terms and Conditions ("Terms") govern your access to and use of Uber for Talent (the "Platform"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and accounts
You must be legally able to enter a binding contract and meet any minimum age requirements in your jurisdiction. You are responsible for maintaining accurate account information and for all activity under your credentials. Keep your password and MFA methods secure, and notify us promptly of unauthorized access.
2. Marketplace roles
- Employers may post jobs, review applications, communicate with talent, and manage engagements subject to Platform rules.
- Job seekers may create profiles, apply to opportunities, and communicate with employers in good faith.
- We provide the marketplace technology; unless expressly stated otherwise, we are not a party to employment or contractor agreements between users.
3. Acceptable use
You agree not to:
- Post false, misleading, discriminatory, or unlawful content.
- Harass, abuse, or impersonate others.
- Scrape, reverse engineer, or disrupt the Platform.
- Circumvent fees, access controls, verification steps, or security features.
- Use the Platform for spam, malware distribution, or unauthorized advertising.
- Share another person’s personal data without a lawful basis.
4. Jobs, applications, and engagements
Job postings and applications must be accurate and made in good faith. Employers are responsible for their hiring decisions and for complying with applicable employment, labor, tax, and contractor laws. Job seekers are responsible for the accuracy of their profiles and credentials. Engagement terms between users (scope, pay, deliverables, IP) should be agreed between the parties; Platform tools may assist but do not replace independent legal advice.
5. Fees and payments
Certain features may require paid plans or transaction fees. Prices, billing cycles, and applicable taxes will be presented before you confirm a purchase. Refunds, if any, follow the policy stated at checkout or in your plan documentation. Failed or disputed payments may result in suspension of paid features.
6. Content and intellectual property
You retain ownership of content you submit, and grant Uber for Talent a worldwide, non-exclusive license to host, display, and process that content as needed to operate the Platform. The Platform’s software, branding, and design are owned by us or our licensors. You may not copy or reuse them except as allowed by these Terms or with written permission.
7. Reviews and communications
Reviews and messages must be fair, relevant, and lawful. We may remove content that violates these Terms or community standards, and may retain records needed for safety, dispute resolution, or legal compliance.
8. Suspension and termination
We may suspend or terminate access if we reasonably believe you violated these Terms, created risk for other users, or if required by law. You may close your account through available account settings or by contacting Support, subject to outstanding obligations.
9. Disclaimers
The Platform is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted availability, hiring outcomes, or the conduct of users.
10. Limitation of liability
To the fullest extent permitted by law, Uber for Talent and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our aggregate liability arising out of these Terms or the Services will not exceed the greater of (a) amounts you paid us for the Services in the twelve months before the claim or (b) one hundred U.S. dollars, except where liability cannot be limited by law.
11. Indemnity
You agree to indemnify and hold harmless Uber for Talent from claims arising out of your content, your use of the Platform, your engagements with other users, or your violation of these Terms or applicable law.
12. Changes and governing law
We may update these Terms by posting a revised version on this page. Continued use after the effective date constitutes acceptance of the updated Terms. These Terms are governed by the laws applicable to our primary operating entity, without regard to conflict-of-law rules, unless mandatory local consumer protections apply. Disputes should first be raised through Support.
